Terms and Conditions
Effective October 21, 2026
Welcome to the website of 11th Hour Compliance LLC. By accessing or using this website you agree to these terms.
These terms describe the services currently offered. Where a purchase, enrollment, or engagement was made under an earlier version of these terms, the terms in effect at that time continue to govern it. Those earlier versions are retained in our records and are available on request.
1. Scope of Services
Current service. 11th Hour Compliance provides embedded CMMC assessment quality assurance for CMMC Third-Party Assessment Organizations (C3PAOs). This covers review of assessment planning and procedural records, review of documented evidence-to-objective traceability, review of assessment work products and data-package readiness, and documented QA finding resolution — all within a scoped engagement.
Services not currently offered. Public training enrollment and new implementation-consulting engagements are no longer offered through this website. Those services are described here only as they apply to existing learners, existing clients, and prior purchases.
Our work supports a C3PAO's quality assurance function. It does not transfer the C3PAO's assessment or certification responsibilities to 11th Hour. We do not conduct certification assessments, issue a Certificate of CMMC Status, act as a regulator or accreditor, or serve as a final appeals authority.
2. Contracts and Statements of Work
Executed agreements govern all services. Where there is a conflict between these terms and an executed contract or statement of work, the agreement controls.
3. Assessment QA Engagements
Each QA engagement is defined by a written scope of work. The scope identifies the activities and records in scope, the review criteria, the review checkpoints and observation arrangements, reporting lines, escalation routes, availability, and record-handling terms.
Formal QA assignments require applicable personnel qualifications, impartiality, authorized access, and contractual conditions to be satisfied. The individual performing the formal QA function must hold the applicable credential and must not be on the assessment team whose work is reviewed.
Fees, scheduling, cancellation, rescheduling, confidentiality, work-product ownership, and any liability provisions specific to a QA engagement are set in the applicable scope of work. They are not published as standard terms on this website.
4. Payment and Refund Policies
Assessment QA engagements
The applicable contract or statement of work governs fees, invoicing, cancellation, and refunds. No standard fee schedule or refund formula is published on this website.
Legacy training purchases
For purchases made while the published training refund term applied, refund eligibility was limited to the first instructional module in accordance with the published terms. That term is not withdrawn for those purchases. New public enrollment is closed.
Legacy consulting and assurance engagements
The applicable contract or statement of work governs refunds. Refunds are not guaranteed once services have begun unless expressly stated in writing.
5. Exceptions
Specific offerings — including bundled programs, discounted enrollments, retainers, subscriptions, or expedited services — may carry alternative terms. Such exceptions are disclosed in writing at the time of contracting or registration.
6. Non-Transferability
Course access, consulting services, QA engagements, and all related deliverables are issued solely to the contracting party or registered individual and may not be transferred, shared, sublicensed, or reassigned without prior written authorization.
7. Legacy Course Access (Training Only)
Training enrollment provided instructional content only and did not include consulting, certification actions, regulatory determinations, or official readiness opinions unless expressly stated in writing.
Learners who enrolled while a course was offered keep the access instructions already provided to them. Course materials and learner records are retained; they are not published on this website and are not offered to new learners.
8. Data Protection and Privacy
Personal and organizational information is collected and processed in accordance with the Privacy Policy. Retention depends on the service that produced the record and, for QA engagements, on the engagement agreement and the record obligations applicable to the C3PAO.
9. Policy Updates
These terms, service structures, and eligibility requirements may change as regulatory or accreditation guidance evolves. Material updates are posted to this site with a new effective date and applied prospectively. Records and purchases governed by an earlier version continue under that version.
10. Intellectual Property
All website content, training materials, methodologies, reports, templates, and deliverables remain the intellectual property of 11th Hour unless otherwise specified in a written agreement. Unauthorized reproduction, redistribution, or commercial use is prohibited.
Ownership and permitted use of engagement-specific QA work products are defined in the applicable scope of work.
11. Limitation of Liability
To the fullest extent permitted by law, 11th Hour shall not be liable for indirect, incidental, consequential, or punitive damages arising from use of the website or services. Liability for engagements is limited to the amounts specified in the governing contract or statement of work.
12. No Legal or Regulatory Guarantees
Our services are advisory and review-focused unless expressly contracted otherwise. 11th Hour does not guarantee assessment outcomes, certification results, accreditation, regulator action, or contract awards, and does not act on behalf of any accreditation body.
13. Governing Law
These terms shall be governed by the laws of the state in which the parent entity is registered, without regard to conflict-of-law principles.
